DMCA Policy for Raspberry Muffins

Raspberry Muffins respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.

This policy outlines the information required to submit a valid notice of infringement and how we handle such notices. It also explains the process for submitting a counter-notification if you believe your content was removed in error.

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied and is accessible on Raspberry Muffins' website in a way that constitutes copyright infringement, you may notify our Designated Copyright Agent by providing the following information in writing:

  1. Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that you claim is infringing and where it is located on the Raspberry Muffins website (e.g., a specific URL or clear description that allows us to locate the material).
  3. Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

Upon receipt of a valid DMCA notice, we will remove or disable access to the infringing material and make a good faith attempt to contact the user who posted the material so that they may have an opportunity to file a Counter-Notification.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to file a Counter-Notification with us. To do so, you must provide a written communication that includes substantially the following:

  • Identification of the material that has been removed or to which access has been disabled, and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Raspberry Muffins may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, we will promptly provide a copy of the Counter-Notification to the original complaining party. If the complaining party does not inform us within 10 business days that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material, we may replace the removed material or cease disabling access to it within 10 to 14 business days or more, after receipt of the Counter-Notification.
